Direitos dos Torcedores: é possível o reembolso de ingresso adquirido antecipadamente?

Ao torcedor é garantido o direito de ter ingressos disponíveis para venda até setenta e duas horas antes do início da partida correspondente quando se tratar de campeonatos de competições profissionais. O Estatuto do Torcedor também prevê que este prazo diminuirá para quarenta e oito horas nas partidas em que as equipes sejam definidas a partir de jogos eliminatórios e quando não seja possível prever a partida com antecedência de quatro dias.
Ocorre que a imprevisibilidade pode afetar a realização do evento esportivo e, com isso, o jogo pode não se iniciar ou, após iniciado, ser declarado suspenso ou encerrado antecipadamente pelo árbitro, por motivos que variam entre a falta de garantia ou segurança para a partida, conflitos graves, mau estado do gramado, falta de iluminação adequada, falta de ambulância, médico e enfermeiros ou outro motivo extraordinário que represente uma situação incompatível com a realização ou continuidade da partida.
Diante disso, pode o torcedor ser lesado por ter adquirido o ingresso de forma antecipada e, por motivos alheios à sua vontade, a partida não ser realizada ou ser suspensa ou encerrada? E se, por ventura, o torcedor não puder ir na nova data estabelecida para a realização da partida?
Nesse cenário, o Regulamento Geral das Competições de 2022 determina que, ao torcedor portador do ingresso de partida adiada ou suspensa, sempre será garantido o direito de optar, antes da realização da partida, pela substituição do ingresso ou reembolso do valor pago, caso escolha não comparecer à continuação ou à nova partida. Destaca-se que este direito respalda tanto a aquisição de ingressos nas plataformas digitais quanto nos pontos de venda disponibilizados pelos clubes.
Para suprir tal garantia, o Estatuto do Torcedor prevê que todos os ingressos colocados à venda devem ser numerados e devem conter o valor cobrado por cada um. Além disso, é assegurado ao torcedor o fornecimento de comprovante de pagamento, logo após a aquisição dos ingressos.
Ademais, em conformidade com o Estatuto, a entidade detentora do mando de jogo implementará, na organização da emissão e venda de ingressos, sistema de segurança contra falsificações e fraudes. Sendo assim, para exercer o direito ao reembolso ou demais direitos garantidos por lei, o torcedor deverá comparecer ao local onde adquiriu o ingresso ou a um dos pontos de venda disponibilizados, caso a compra tenha sido realizada de forma online, sempre antes do início da partida e com o comprovante de pagamento do ingresso.
Vale lembrar que caso o torcedor opte por comparecer à partida que foi adiada ou suspensa, o Regulamento Geral das Competições lhe assegura o acesso ao jogo portando o ingresso da partida original.
